The Federal High Court in Lagos has ordered the Nigerian Correctional Service (NCS) to release Orji Uzor Kalu from detention.
The court delivered the judgment on Tuesday morning, June 2, after listening to an application filed by the former governor.
The Economic and Financial Crimes Commission (EFCC) did not oppose the application.
Orji Uzor Kalu was sentenced to 12 years imprisonment over N7.1bn fraud after he was found guilty on the 39-count charges brought against him by the Economic and Financial Crimes Commission(EFCC) on December 5, 2019.
On May 8, the Supreme Court nullified the trial of Kalu and his co-convicts on the grounds that Mohammed Idris, the trial judge had been elevated to the court of appeal at the time of the case, and ought not to have presided over the matter while he was an appeal court judge.
